These Terms of Service (“Terms”) govern your access to and use of LanguageTest.in (the “Service”), operated by Talent Networking, a sole-proprietorship registered in Hubli, Karnataka, India (“we”, “us”, “our”).
By creating an account or using the Service, you agree to these Terms. Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
1. The Service
LanguageTest.in is an AI-powered language exam preparation platform offering mock exams modelled on the Goethe-Zertifikat, DELF, DELE, CILS, and other internationally recognised certifications. Mock exams, AI-generated feedback, and AI scores are provided for preparation purposes only and are not endorsed by, or substitutes for, the official exam bodies.
2. Eligibility and Age Restrictions
You must be at least 18 years old to independently create an account and agree to these Terms. If you are under 18 years of age, you may only use the Service if a parent or legal guardian creates the account, agrees to these Terms, and provides supervision for your use of the Service.
3. Accounts
- You are responsible for keeping your password confidential.
- You are responsible for all activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
- We reserve the right to suspend or terminate accounts engaged in fraud, abuse, or violation of these Terms.
4. Subscriptions and Payments
- Paid plans are billed in Indian Rupees (INR) and prices are inclusive of applicable GST unless otherwise stated.
- Payment is processed by Cashfree Payments. We do not store your credit/debit card or UPI details on our servers.
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date through your account settings.
- Refunds are strictly governed by our Refund & Cancellation Policy.
5. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of any applicable Indian or local law.
- Attempt to reverse-engineer, scrape, or otherwise extract our exam content, AI prompts, or underlying technology.
- Resell, redistribute, or sub-license access to your account or our content.
- Submit responses generated by another AI as your own work — our system is designed to detect this and may suspend your account.
- Upload viruses, malware, or any code designed to interrupt, damage, or limit the functionality of the Service.
- Use the Service to harass, abuse, or harm other users or our staff.
6. AI Scoring — Nature and Limitations
Our AI scores and feedback are produced by large language models and speech-recognition systems. They are indicative and intended solely for self-improvement. We do not guarantee that an AI-predicted score will match the score you obtain in an official exam. Where possible, we publish how our scores have correlated with reported official results, but individual results will vary.
7. Intellectual Property
- Our Content: All content on the Service (exam blueprints, AI prompts, sample questions, articles, branding) is owned by Talent Networking or its licensors. You receive a limited, non-transferable, revocable licence to use the Service for personal, non-commercial preparation.
- Your Content: You retain ownership of the text and audio responses you submit. You grant us a non-exclusive licence to process them for the purpose of providing the Service (scoring, feedback) and to use anonymised, aggregated data for improving our models.
- Third-Party Trademarks: Trademarks of third-party exam bodies (Goethe-Institut, France Education International, Instituto Cervantes, etc.) belong to their respective owners and are used here for descriptive reference only.
8. Disclaimers
The Service is provided on an “as is” and “as available” basis, including scheduled downtime for maintenance. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
9. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or ₹5,000, whichever is higher. We are not liable for indirect, incidental, consequential, or punitive damages.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or damage (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service.
11. Termination
You may delete your account at any time from your account settings. We may suspend or terminate your account for breach of these Terms with or without notice. On termination, your right to use the Service ceases immediately. Sections that by their nature should survive (e.g., Sections 7, 8, 9, 10, 13) survive termination.
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified via email or an in-app banner at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Hubli, Karnataka, India.
